Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of elevating platforms falling off elevated forklift forks while working at elevations from such platforms: (a) Maintenance Department- On or about January 10, 2006, the employer failed to ensure that the wheels of the Nissan #4 forklift were blocked/chocked to prevent the truck from moving while a maintenance employee was raised to a height of approximately 12 feet. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide and require the use of wheel blocks around the tires of in accordance with American Society of Safety Engineers (ASME), B56.1-2000 Safety Standard for Low and High Lift Trucks, Section 4.17. In accordance with the requirements of 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
