Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to the hazards associated with operating a fork lift truck without wearing the operator restrain system (seat belt) supplied by the manufacturer. ASME B56.1-2000,5.319 safety Standard for Low and high Lift Trucks, requires manufactures to provide and operators to wear restrain systems: a)At the warehouse: Employee was exposed to crushing injuries due to the potential of tips overs while operating a fork lift truck model SC-4000, Serial number 9H133305E, approximate weight 6,260 Lb., on or about March 8, 2006. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to require and enforce the use of the seat belts that are provided on the fork lift trucks. NOTE: The employer is required to submit abatement certification for this item, failure to comply will result in an additional penalty of $1000.00 as per 29 CFR 1903.19.
