Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees. Koch Foods of Cumming fails to furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees. This practice of failing to furnish employment and a place of employment which is free from recognized hazards that are causing or likely to cause death or serious physical harm to employees was most recently observed on or about March 1, 2007 at the site located in Cumming, Ga., and led to employees being exposed to struck by and or crushing hazards when operating the Linde battery powered forklift - Model No. E16-0236V; Serial No. H2X 324N0163816 without the seatbelt. To abate these violations Koch Foods of Cumming must ensure that a seatbelt is installed and used by employees during the operation of the forklift. Date by which the violation must be abated: Immediately upon receipt of the Citation and Notification of Penalty. Pursuant to 29 CFR 1903.19(c), Koch Foods of Cumming, within 10 days of this Citation and Notification of Penalty, must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from hazards related to the operation of forklifts without a seatbelt.
