Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to spreader bars that were not weight rated or inspected for wear and/or damage. The hazard is recognized and addressed in ASME B30.20-1993. A.) On or about 8/23/06, in various areas of the facility employees are exposed to foot and hand hazards as hoists are equipped with spreader bars that have not been weight rated or inspected for wear and/or damage. There was evidence of wear/damage on one of the bars inspected. There was a feasible and useful method to correct the hazard: Some methods, include, but are not limited to: Rating the spreader bars capacity as to each units' weight limit and inspecting the spreader bars for evidence of wear or damage. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
