Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that an employee was exposed to vehicle struck-by hazards: (a)In the center lane of the US Highway 80 at Rainbow Foods Grocery: On September 20, 2006, an employee was fatally struck by a privately owned vehicle while removing a paper joint from the center lane of the roadway. Feasible and acceptable methods of abatement for this hazard include the placement of signage and traffic control devices to channelize vehicle traffic around the activity area as required in the Manual on Uniform Traffic Control Devices.
