Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards: LOCATION: Job Site, Dakota Court a) The employer did not train their employees to follow safety precautions while operating the Bob-Cat Lawn Mower, thus exposing the employees to amputation hazards, on or about 06/22/07. Among other feasible methods, one feasible and acceptable abatement method to correct this hazard is to... 1. Follow the instructions in the ANSI B71.4-2004 for Commercial Turf Care Equipment-Safety Specifications, page 38, section 1.0 Training; # 1.1 "Read the operators Manual and other training material. If the operator(s) or mechanic(s) cannot read English it is the owner's responsibility to explain this material to them". #1.3 "All operator and mechanics should be trained. The owner is responsible for training the users". NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
