KRS 338.031(1)(a): Every employer did not furnish to his employees employment and a place of employment which were free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that: a. P.D. Automation failed to adequately protect three(3) employees from engulfment from clay when entering and working in a clay hopper on or about 02-23-06 located at Owensboro Brick and Tile, Co., in Owensboro, Kentucky. One feasible and acceptable abatement method, among others, to correct this hazard is to achieve a zero mechanical state through the use of lockout/tagout and to eliminate the engulfment hazard through the removal of the engulfing material.
