Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by and or crushed by a Volvo bucket loader when driven in an unsafe manner. a.On or about May 09, 2006, an employee was operating a volvo wheel loader in the direction of travel with the bucket elevated at a position that obstructed his forward vision and struck another loader injuring the operator. Among other methods, one feasible and acceptable abatement method to correct the this hazard is to provide effective training for employees operating bucket loaders, supplemented with procedures and those work rules necessary for a safe operation.
