KRS 338.031(1)(a): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees in that: a.An employee of Commercial Pavers, Inc., was assigned to operate a WIRTGEN 1900 Cold Milling Machine on a soft ground incline at the Cherokee Park golf course located at 2501 Alexander Road, Louisville, Kentucky, when the manufacturers operating instructions warns the operator to operate the machine over sufficiently solid ground only and only travel on gradients directly uphill or downhill.
