Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about January 29, 2007, and at times prior thereto, at a workplace located on US Hwy 271 South, approximately 0.3 miles North of FM 1499, in Paris, Texas; At least four employees, who were removing channelizing devices from a work zone, were exposed to the hazards of being struck-by a motor vehicle. Among other methods, one feasible means of abatement includes but is not limited to complying with the Texas Department of Transportation, Traffic Control Plan for Mobile Operations on Divided Highways, TCP (3-2)-98 which requires a shadow vehicle equipped with a truck-mounted attenuator to follow 60 to 100-feet behind the work vehicle.
