Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: On or about January 10, 2007, at a work site located at 4922 Airline Drive, in Metairie, LA 70001, the employer by not redirecting west bound traffic around the work area, exposed at least two employees, who were walking and working in the open lane, to the hazard of being struck- by a motor vehicle. Among other methods, one feasible means of abatement includes but is not limited to: Complying with Section 6C.05, Transition Area, of the Manual on Uniform Traffic Control Devices, Millennium Addition, December 2000.
