Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to struck-by hazards from masonry materials thrown from elevations. On or about September 8, 2006, and at time prior thereto, at a workplace located at 4322 Woodfin, Dallas, Texas 75220, employee(s) threw stones off exterior scaffolding more than 20 feet in elevation, without enclosures or barricades to the drop zone to prevent employees at lower levels from being struck by the stones. OR IN THE ALTERNATIVE: 29 CFR 1926.252(a): Materials were dropped more than twenty (20) feet to a point lying outside the exterior walls of a building without using an enclosed chute of wood or equivalent material: On or about September 8, 2006, and at time prior thereto, at a workplace located at 4322 Woodfin, Dallas, Texas 75220, employee(s) threw stones off exterior scaffolding more than 20 feet in elevation, without enclosures or barricades to the drop zone to prevent employees at lower levels from being struck by the stones.
