Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught in moving parts: At the construction site located at: Skillman Street and E. Northwest Highway, Dallas, Texas. On or about June 05, 2006, an employee standing near or next to a trenching operation was exposed to the hazard of being caught by the trencher attachment of a 3500 Ditch Witch Trencher while he was watching for underground obstructions. AMONG OTHER METHODS, SOME FEASIBLE AND ACCEPTABLE MEANS TO ABATE THESE HAZARDS ARE: a). Keep everyone at least 6-feet (2 m) away from machine and attachments while equipment is operating as required by the operator's manual; b). Allow 3-feet (1 m) between end of chain and obstacles as required by the operator's manual.
