Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employees were exposed to falling, and crushing hazards. a)Elevator shaft doors/gate on the 1st floor, 4th floor, and 7th floor. On or about 12/16/05 The elevator shaft doors/gate did not self close.. b)Elevator shaft doors/gate throughout the building. The elevator car doors/gate were not electronically interlocked to prevent movement of the elevator when the hoist doors/gate were open. c)Elevator car. The elevator car had no walls or roof. d)Elevator on site. The elevator was not equipped with a car safety devices. e)Elevator on site. The capacity of the elevator was not posted. ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD, AMONG OTHERS, TO CORRECT THIS HAZARD IS: to follow ASME A 17.3-1993 Safety Code for Existing Elevators. -Section 2.6.2 "Closing of Hoistway Doors" which states that hoistway doors shall self close. -Section 2.7.1 "Hoistway Door or Gate Locking Devices" which states that these gates require electro-mechanical interlocks to keep them closed when the elevator is moving, and Section 2.7.4 "Restricted Opening of Hoistway Doors" which states that the hoistway door shall prevent the opening of the door when the elevator is not in the landing zone. -Section 3.4.1 "Car Enclosures" Which states that cars shall be fully enclosed on all non- entrance sides and on top. -Section 3.5.1 "Car Safeties" which states that safeties shall pe provided to stop the car with its full rated load from the governor tripping speed. -Section 3.7.4 "Capacity Plates" Which states that every elevator shall have a capacity plate. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION AND DOCUMENTATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19NCE
