North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to rotating/whipping "stop" inside spindle tube: a)The employer failed to implement an adequately protective procedure to protect the tailman from being struck by a rotating/whipping "stop" inside spindle tube on August 25, 2006. Among other methods, feasible and acceptable abatement methods to correct this hazard are: 1-To develop procedures for two man operation of lathe in which the tailman does not have to soley depend on the observation of the operator to protect him from being struck. This could include use of sensor mat or switch for tail man to insure lathe will not operate until tail man is in safe position.
