North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: the potential of being struck by falling trusses due to a failure to follow the manufacturer's recommendation or the Building Component Safety Information (BCSI B1, B2, and B3) Guide to Good Practice for Handling, Installing, and Bracing of Metal Plate Connected Wood Trusses: a)jobsite- on or about February 15, 2006 two employees were injured when approximately twenty-eight (28) fifty-five feet long wooden scissor trusses collapsed to the ground when the employer failed to ensure that the following manufacturer's and the BCSI 1-03 recommendations were followed: 1) The employer failed to ensure that, as a minimum, 2x4 stress-graded lumber was used as bracing. 2) The employer failed to ensure that, as a minimum, 27" long 2x4 spacer pieces were used for top chord temporary bracing (TCTLB) or ensuring a minimum end distance of 1.5 inches. 3) The employer failed to ensure that, at a minimum, 10d (0.128x3"), 12d (0.128x3.25"), or 16d (0.135x3.5") nails were used on all bracing and spacing members. 4) The employer failed to ensure that all diagonal bracing was completely installed after each set of four trusses were set and prior to installing the next set of four trusses. 5) The employer failed to ensure that all temporary bracing was connected to each truss by a minimum of two of the required sized nails.
