Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that the seat/safety bar was malfunctioning which allowed the Bobcat skid steer loader to be operated with the seat/safety bar in the raised position, exposing the employees to a hazard of being ejected from the loader during operation: a.Quincy Castings, Inc. located in Quincy, Ohio: On or about January 31, 2007, the employer did not ensure the Bobcat skid steer loader located adjacent to the mold dumping department was equipped with a functioning safety bar that would prohibit movement of the machinery if the safety bar were in the up position. Employees could be exposed to the hazard of being ejected from the loader during operation if the safety bar was not lowered. No abatement certification or documentation is required for this item.
