Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and run over hazards: On or about 04/11/06, at U. S. Highway - 27, employees were exposed to the hazards of being struck and run over by vehicular equipment while operating a flat bed truck and sitting on a lowered tailgate door of a pick-up truck without using restraining devices such as, but not limited to seat belts. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to prohibit employees from operating this type of equipment and riding on tailgate doors without wearing restraining devices, such as but not limited to seat belts.
