a) Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to falling out of the back of and being struck by the loading trucks. On or about 02/13/06, employees engaged in the task of harvesting vegetables were exposed to falling out of and being struck-by a loading truck that was moving in reverse. Among other methods, one feasible and acceptable method to correct this hazard is to ensure employees do not ride in the back of the loading trucks. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION. On or about 02/13/06, employees were exposed to a struck-by hazard while working near a tomato sorting truck that moved in the reverse direction without having a backup alarm or a spotter. Among other methods, one feasible and acceptable method to correct this hazard is to install a back-up alarm with audible sound, or consider the use of a ground guide or signal person (spotter).
