Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to a crushing hazard. On or about 02/08/06, an employee was operating a Hustler Super Z 60 riding lawn mower on a slope greater than 25 degrees near a pond, and was not trained to safely operate the mower in accordance with the manufacturer's recommendation. Among other methods, one feasible and acceptable method to correct this hazard is to provide employees with training on equipment controls, components, their functions, and limitations; and instruct employees on how to conduct a careful survey and record of the land and worksite features, prior to operating the equipment, as outlined in the equipment operator's manual.
