Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: On or about 12/10/2005, employees were exposed to the hazard of being struck by a railroad car that had a damaged knuckle when positioned between the railcars. (a) Among other methods of abatement,one feasible and acceptable method to correct this hazard is by the employer ensuring that damaged railroad cars taken out of service. (b) Have the employer develop and implement an effective communication system where the railroad yard employees and the dumping operator have visual and radio contact at all times during railroad car movement. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
