Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards: On or about 11/16/2005, on a construction site where underground pipes where being connected an employee that was bolting up fittings was exposed to a caught in hazard when the employer failed to determine if anyone was in the excavation before back filling it. Among other methods of abatement, a feasible and acceptable method to correct this hazard is to perform an inspection of the excavation and surrounding area prior to back filling, as required by the manufacturer. IN THE ALTERNATIVE: 29 CFR 1926.651(k)(1): Daily Inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indication of failure of protective systems, hazardous atmospheres, or other hazardous conditions: On or about 11/16/2005, an employee who was bolting up fittings was exposed to the hazard of being crushed by the weight of the soil when the excavation he was working in was not inspected prior to being back filled by earth moving equipment.
