29 CFR 1926.600(a)(6): All equipment covered by this subpart did not comply with the requirements of 1926.550(a)(15) when working or being moved in the vicinity of power lines or energized transmitters. OR IN THE ALTERNATIVE A.R.S. 23-403.A.: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to their employees, in that the employer allowed employees to operate mechanical equipment where it was capable of vertical, lateral, and/or swinging motion closer than 10 feet to overhead power lines, in direct violation of A.R.S 40-360.42. (a) Approximately 16 feet south of electrical pole: The operators of the Caterpillar 350L Excavator allowed the boom to come within 10 feet of the overhead power lines. (b) Approximately 100 feet from the Caterpillar 350L Excavator: The operator of the Caterpillar 950G Wheel Loader allowed the equipment to come within 10 feet of the overhead power lines.
