Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to hazard or loosing control of the tow vehicle and being injured in an automobile crash: (a)Employees were using were using the wheel lift device from a Vulcan truck, Unit 306, with J-Hooks as the primary towing device. This practice exposed employees to the hazard of loosing control of the tow vehicle and being injured in an automobile crash if one side of the J-Hook were to fail. Towing a vehicle using only the J-hooks and chains is not in conformance with Section IVA of the Vulcan Owner's Manual. The J-Hooks were not being used as a safety chain as stated in Section IVA of the Vulcan Owner's Manual. A feasible means of abatement includes, but is not limited to: Training employees in the proper use of the wheel lift and approved methods of towing as discussed in the Vulcan Owner's Manual Section IVA and developing an standard operating procedure to use as part of the training. In addition, adequately supervise and audit employee's work activities to assure that work is being completed in conformance with the recognized methods of towing using the wheel lift. Documentation of abatement is required. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.
