Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by vehicle traffic hazard: a)job sites - Employee(s) operating wreckers were required to stop upon the traveled portion or the shoulder of a highway and were not required to place warning devices to forewarn oncoming vehicular traffic of their presence. On or about April 3, 2006 an employee was fatally injured when he was struck by a vehicle while he was along the side of I-40 preparing a disabled truck for towing. Abatement note: One feasible and acceptable abatement method, among others, to correct this hazard is place warning devices to warn motorist in advance.
