Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: (a) Location - 39 Linwood Avenue, Methuen, MA: On or about 9/7/05, an employee was struck by a tree limb that was cut in a hazardous manner. Among other methods, one feasible and acceptable means to abate this hazard is to ensure that each tree or limb is cut in accordance with ANSI Z133.1-2000, for "Arboricultural Operations, Pruning, Repairing, Maintaining, and Removing Trees and Cutting Brush - Safety Requirements.
