Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a Bobcat A300 All Wheel Steer (AWS) Loader: On or about 4/18/06 at Fetter's Landscaping and Garden Center, LLC west lot, an employee was struck by a Bobcat A300 AWS Loader that was being operated by a user who was not trained in the safe operation of the machine. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to require all authorized users to complete the Bobcat Skid-Steer Loader Operator Training Course and demonstration of competence as described in the Bobcat A300 Operation and Maintenance Manual. **Abatement documentation required for this item**
