Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of potential injury and delayed rescue from a confined space: a) Location - St. John's Prep School, Spring & Summer Streets, Danvers: On or about August 4, 2005, an employee was performing hot work (soldering) inside a manhole without an attendant as part of a confined space entry program. Among other methods, feasible means of abatement to correct this hazard is: 1) Develop, implement, and complete a confined space permit entry system meeting the requirements of OSHA 1910.146 and/or ANSI Z117.1-1989. 2) The use of an effective retrieval/rescue method, i.e., mechanical means that would include a fall arrest system, where appropriate, for employees for entry/rescue/exit. 3) Provision of an effective means of communication by an attendant to necessary rescue services.
