Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) At AmeriCold Logistics, LLC - The employer failed to ensure that employees involved in the securing of frozen goods were protected from a fall hazard. On or about October 21, 2005, two employees were lifted up approximately 25 feet to the upper level cold storage rack using the forks of an industrial vehicle and were not using a harness, a secured cage or any other means to safeguard themselves from a fall hazard.
