Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Construction site: The Terex Aerial Scissor Lift, serial number 99360123 with maintenance defects was not taken out of service until all maintenance defects were repaired or replaced, exposing employees to overturning of the lift. Among other methods, one feasible and acceptable abatement method to correct this hazard is: To comply with ANSI/SIA 92.6, paragraph 7.3, dated 1990. Aerial platforms that are not in proper operating condition shall be immediately removed from service until repaired.
