Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck by returns not secured: a) On site, trailer stripping area - this employer is the creator of the hazard and exposes employees of CVS Pharmacy and their own to being struck by unsecured and unstable loads when the trailer comes into the distribution center for unloading. This company's drivers are exposed to unstable and unsecured loads while making deliveries away from the distribution center, on or about 11/21/05. One means of feasible abatement, among others, is for the drivers to always use the straps and load securing bars after making a delivery and for return items to the distribution center. Load stabilizing bars and sheets of plywood are put on each trailer before the load leaves the distribution center along with securing straps.g
