Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) On or about 2/1/06, the job-made working platform attached to the forks of the powered industrial truck used to elevate employee (4 feet or higher), was not equipped with a standard railing and toeboard, exposing employee to a fall hazard. Feasible means of abatement are: 1. Only utilize safety platforms that meet the requirements of American Society of Mechanical Engineers, ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks, Section 7.36 entitled Platforms-Elevating. 2. Inspect all platforms prior to each use to ensure there are no defects. 3. Instruct employees in the proper use of elevated platforms and their potential risks and hazards.
