Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee using a Bobcat Loader as an elevated working platform was exposed to a fall hazard: a.Location - Windham Lakes Phase III worksite: On or about June 13, 2005, an employee cutting the fronds of a palm tree fell while standing on the elevated bucket of a Bobcat Loader, model T300. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to follow the manufacturer's operating instructions as noted in the Operation and Maintenance Manual, specifically, "Never use the loader as a manlift or personnel platform".
