Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being crushed by the Windham powered industrial fork truck in the event of a rollover. a) Throughout lumber yard; The seat belt was missing from the Windham diesel powered industrial fork truck being used to ferry bundle of lumber and other wood products throughout the yard and for loading and unloading trailers. Operators were exposed to the hazard of being injured by a potential roll-over. Among other methods, one feasible and acceptable method to correct this hazard would be to replace missing seat belts and to require that the operator of the powered lift tractor truck utilize the seat belt.
