Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about February 8, 2006, employees operating the below following equipment: 1. Euclid R35 (serial #64409) - horn not operative 2. Euclid R35 (serial #324TD73621) - horn not operative 3. Caterpillar (serial #0990405633) - horn not operative were not provided operable warning devices such as, but not limited to, working horns. One feasible and acceptable abatement method includes, but are not limited to the following: a. Follow the Equipment Manufacturers Institute (EMI) safety manual for operator and mechanics of off road equipment which states, "all equipment shall have an operable warning device."
