Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between and struck-by hazards: a)A-Du Well Auto Salvage & 5135 Emerson St. in Denver, CO: The employer did not ensure only trained and authorized operators were permitted to operate the rough terrain forklift. This condition exposed employees to caught-between and struck-by hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 5.16.1 "Only trained and authorized operators shall be permitted to operate a rough terrain forklift truck. Operators of rough terrain forklift trucks shall be qualified as to visual, auditory, physical, and mental ability to operate the equipment safely according to paragraphs 5.17 and all other applicable parts of Section 5". NOTE: The ASME B56.6-1992 Section 5.16.1 standard can be obtained by contacting the American Society of Mechanical Engineers, 345 East 47th Street, New Tork, NY 10017. b)A-Du Well Auto Salvage & 5135 Emerson St. in Denver, CO: The employer did not ensure an effective operator training program was developed and implemented. This condition exposed employees to caught-between and struck-by hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 5.17.4 "An operator training program should consist of the following:" 1)Careful selection of the operator, considering physical qualifications, job attitude, and aptitude; 2)Emphasis on safety of stock, equipment, operator, and other personnel; 3)Citing of rules and whey there were formulated; 4)Basic fundamentals of rough terrain forklift truck and component design as related to safety, loading, mechanical limitations, center of gravity, stability, ect.; 5)Introduction to equipment, control locations, and functions. Explain how they work when used properly and problems when used improperly;6)Supervised practice on operating course remote from normal activity and designed to simulate actual operations; 7)Oral, written, and operational performance tests and evaluations during and at completion of the course; 8)Refersher courses, which may be condensed versions of the primary course, and periodic, "on job" operator evaluation: and 9)Understanding of nameplate data and operator instructions and warning information appearing on the rough terrain forklift truck.
