Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause serious physical harm to employees, where the use of seat belts was not enforced when employees were operating forklifts; (a) Exel,Inc. 17650 East 32nd Place, Aurora, CO 80011: The employer did not enforce the use of seat belts while employees operated a Case industrial forklift truck. This exposed employees to struck-by hazards while operating the forklifts. Among other methods, one feasible and acceptable method to correct this hazard is to re- train employees and supervision to better recognized the hazards associated with operating forklifts without wearing seat belts. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
