KRS 338.031(1)(a): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a.Moving elevator parts such as counterweights, elevator cars, etc. which caused an employees right leg to be amputated when the leg was caught between a spreader beam and the moving South Elevator Car #1 Counterweight, in the West Bank Elevator Shaft located in Riverview Square at 201 West Main Street in Louisville. Among other methods, two feasible and acceptable abatement methods to correct this hazard would be to control the energies of all cars or to install a guard between hoistways as described by the Elevator Industry Field Employees Safety Handbook published through NEII (National Elevator Industry, Inc.) which was recognized and utilized by U.S. KONE.
