Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by overturning powered industrial truck(s). (a)Plant #2, Baking Department's Compactor-Loading Area - On or about Wednesday, July 11, 2007 at 10:15 AM, an employee operating Toyota Electric Powered Industrial Truck, Model 5FBE18, S/N 17950, was not wearing the truck's seatbelt as he drove bringing boxes of rejected product to the compactor. (b)Plant #1, Loading Dock - On or about Thursday, July 12, 2007 at 3:35 PM, an employee operating Toyota Electric Powered Industrial Truck, Model 7FBEU18, S/N 17141, was not wearing the truck's seatbelt as he drove into a Southeast Trucklines trailer with a pallet of #5710 product. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce the use of operator restraint systems at all times among all employees who operate powered industrial trucks.
