Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by falling pallets of frozen chicken. (a)Collins, MS - On or about April 24, 2007 - Maintenance employees were exposed to a struck by hazard while repairing damaged support legs on a frozen chicken storage rack. The employer did not insure that pallets containing frozen chicken weighing between 2000 and 2500 pounds were removed from the rack prior to allowing employees to repair damaged legs directly beneath this storage. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: Insure that storage racks are designed and built to specification outlined in ANSI MH16.1-2004 "Specification for Testing, and Utilization of Industrial Steel Storage Racks." Specifically, when repairs are needed the employer must comply with Section 1, paragraph 1.4.9 which reads in part: "Upon any visible damage, the pertinent portions of the rack shall be unloaded immediately by the user and the damaged portion shall be adequately repaired or replaced. Additional guidance on safe use of steel storage racks can be obtained by referring to ANSI MH16.2 1984 (R1996) "For the Use of Industrial and Commercial Steel Storage Racks - Manual of Safety Practices / A code of Safety Practices."
