Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to the hazard of being thrown from compactor when operating without using a seat belt: (a)213 Clermont Drive Jobsite - On or about March 6, 2007 an employee was injured when the CAT vibratory compactor turned over and pinned the operator under the ROPs of the compactor. Among other methods, one feasible and acceptable abatement methods to correct this hazard includes but not limited to: Instruct employees to wear seat belt when operating compactor.
