Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to a crushed by hazard when the Kubota tractor overturn and pinned the employee operating the tractor under the rollover protective structure (ROPS). The employee was not wearing the factory installed seatbelt that could have prevented his expulsion from the ROPS protection. (a)Chancellor Funeral Home: Training for employees who operate a Kubota tractor was not adequately enforced to assure operators followed manufacturers instruction to wear seatbelts when operating with ROPS in place. Among others, one feasible and useful abatement method to correct this hazard is to train the operators and assure they comply with the requirements of Kubota Tractor operator's manual section on Operating the Tractor: "Seat Belt" "WARNING" "To avoid personal injury:" "Always use the seat belt when any ROPS or CAB are installed." "Do not use the seat belt if a foldable ROPS is down or there is no ROPS."
