Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: falling 7 feet 5 1/2 inches from the forks of a forklift. (a)At North end, West side, of middle section of Martie's Steak and Fish House building, located at 301 Tuscaloosa Road, Columbus, Mississippi - On or about December 7, 2006, employees were exposed to falling 7 feet 5 1/2 inches to the ground while working from a 2 x 10 inch board supported on the forks of a Lull Highlander industrial forklift.
