Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard of being thrown from: (a)Prestress Yard - During the period November 14, 2006 through December 18, 2006 employees were operating Tucker T-630 concrete trucks without wearing seat belts while transporting concrete from batch plant to stressing beds. (b)Wire Shop - On December 14, 2006, an employee was operating a forklift without wearing a seat belt while moving wire from the wire shop. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO: Require operators to wear seat belts when operating Tucker trucks and forklifts.
