Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being crushed-by a forklift during a tip-over event while operating powered industrial trucks at Chickasaw Farm Services, Inc., without wearing a seatbelt. The employer violated this section of the Act on or about November 15, 2006 when the Nissan 35 forklift was operated without a seatbelt secured. Among other methods, one feasible method to abate this hazard is to install seatbelts on the forklift.
