Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being crushed by an overturned powered industrial truck. (a)Production area near Strainer #2, and West of North end of Werner-Pfleiderer 120 mm Twin-Screw Extruder - Employee(s) were operating the Nissan 50 powered industrial truck, #F42, while not wearing the operator's seat belt. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require the wearing of operator restraint system belts anytime anyone operates a powered industrial truck.
