Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by or engulfed in a collapsing wall of ice: (a)Employees entered the ice room on or about March 2, 2006, after the ice makers had run during an off-shift creating an accumulation of ice from floor to ceiling exposing employees to an engulfment or struck by hazard from shifting or falling ice when using shovels and picks to move the ice into a guarded auger located along a wall to the left of the floor level entry door. Among other methods, feasible and acceptable abatement methods to correct these hazards are: 1) develop and implement written safe work practices for routine and non-routine tasks that are required to be performedin the ice room and provide employees with information and training on how to protect themselves from hazards associated with the work in the ice room; 2) ensure that the safe work practices are enforced; and 3) install an ice rake or other automated system to deliver the ice to the auger which will prevent employees from entering the room when hazardous conditions are present.
