Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being struck by an improperly-attached steel- frame operator's cage, which was mounted on the Jarraff Mechanical Tree Cutter. (a)Southern Natural Gas Pipeline Mile Post 34.600, T2N, R9E, Section 26, Smith County, MS - On or about July 8, 2005, while employees operated Jarraff Mechanical Tree Cutter, #SJ3, S/N WH053J0117, they were exposed to fatal injury due to the operator's cage having been repaired, and re-attached to the machine, with cast-iron post- extensions and "hammer union" couplers, which were substituted for original parts during the December 2004 repair of the operator's cage. Among other methods, one feasible and acceptable abatement method to correct this hazard is to require that the machine be repaired to the manufacturer's original design and materials of construction.
