Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by moving trucks at the Peco Feed Mill construction site where on or about July 7, 2005,at the materials painting area, no designated walkways were established, separated a safe distance from the raodway where vehicles were moving to deliver loads. Among other methods, one feasible and acceptable method to abate this hazard is to install barricades for employee protection conforming to Part VI of the Manual on Uniform Traffic Control Devices, Millennium Edition, Part 6, Temporary Traffic Control, Section 6F.55, Channelizing Devices, Figure 6F-4, Channelizing Devices which are incorporated by reference, 1926.200(g)(2) and 1926.202. OR IN THE ALTERNATIVE: 29 CFR 1926.752(c)(1): The controlling contractor did not ensure that adequte acess roads and storage spaces were provided and maintained for the safe delivery, storage and movement of equipment and pedestrians:
