Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being thrown from or crushed by an overturning forklift: (a)Throughout Facility - Employees were exposed to being thrown from or crushed by overturning forklifts while operating equipment with rollover protective structures and not wearing a seat belt or the seat belt was missing on forklifts identified as Clark #297, Cat #195, Cat #296, Clark #3, and a Hyster. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure the use of seat belts on all equipment having rollover protective structures.
